Tip: Warranty period for house construction

Once they have moved into their dream home, builders do not initially think about defects and construction errors. After all, everything is new and the joy of owning their own home is great. But especially in the first few years after moving in, it is important to observe and check the house for weak points. This is because, according to the German Civil Code (BGB), the warranty period ends five years after the building has been accepted. After this period, private builders are liable for the elimination of defects and the construction measures themselves.

To avoid this, the Association of Private Building Owners (VPB) reminds people to keep an eye on the warranty period. At the latest at the end of the period, at least half a year before it expires, it is advantageous to engage an independent building expert, advises the VPB. In a so-called final inspection, the building expert checks the house for possible construction defects that only become visible at a later point in time and can also cause major damage. In addition, from a legal point of view, house construction only ends with the final inspection. If the builder notices any defects before then, a complaint must be lodged.

If a defect occurs in the house, such as cracks in the interior of the masonry or moisture damage to windows, this should be reported. The correct legal term for the complaint is "notice of defect". Building owners should make sure that the notice of defects is in writing and includes a reasonable deadline by which the defects are to be remedied. Another very important aspect is that the construction company responsible for the defect is notified and not another one by mistake. This is because only the contractor responsible for the defect is required to rectify it. If another construction company has been requested by the owner to rectify the defect, it can charge for the journey and working time.
