Ruling: Energy certificate must also be provided on site

The energy certificate must also be made available to prospective buyers and tenants during the property inspection. It must be displayed in a clearly visible place or presented without being asked. The German Environmental Aid (DUH) now points this out.

In the case in question, DUH found that the duty to provide information had been disregarded during two open apartment viewings. The energy performance certificate had been provided to the prospective buyers in advance in the invitations, but not during the viewings themselves. DUH then took the matter to the Berlin Regional Court (LG). The LG gave it right (Az LG Berlin 101 O 15/20).

According to DUH, the ruling is important for the following reasons: prospective buyers and tenants can identify energy-intensive buildings, learn more about the climate impact and also derive future final energy costs, for example for heating. DUH has announced increased controls in this area.
