Neighborhood: verdict in dispute over seven-meter-high cross

In Düsseldorf, a woman was ordered by the district court to remove a wooden cross, approximately seven meters high, from her garden. The woman's neighbor had brought an action before the district court because she felt considerably disturbed by the cross and wanted it removed. Although she had already been granted justice there, the woman appealed against the ruling. However, the district court has now also ruled in favor of the neighbor.

The massive height would visually impair the residential complex. In addition, the cross would give the garden the appearance of a memorial, according to the district court. In addition, it did not believe that the neighbor - as claimed by the woman - had agreed to the installation of the cross.

According to various media, the cross had a religious significance for the woman. The cross was not erected for nothing with a height of 7.36 meters in reference to the 736-meter-high Mount Golgotha, where Jesus is said to have been crucified. The judgment (file number 25 S 56/21) is final.
