WEG: WiE criticizes BMJ plans

The Wohnen im Eigentum association has criticized the Federal Ministry of Justice's (BMJ) plans to introduce an online-only owners' meeting and has compiled eleven arguments against such an approach. Among the arguments put forward by WiE are that older and educationally disadvantaged citizens could be excluded, that the possibility of exercising voting rights would be unnecessarily restricted and that the voting rights of homeowners would be interfered with.

WiE also states that many aspects are still unclear. For example, the association states: "It is still unclear how the resolution for an online-only meeting can be reversed if the online-only meeting does not prove successful." The association also wonders why changes are needed again, as the last WEG reform only came into force on December 1, 2020.

In addition, owners could already decide whether they want to appear on site or attend owners' meetings in person, provided they have decided on this procedure by majority vote. Only the administrators would have to be present. The introduction of an online-only owners' meeting would mean that owners would no longer be free to decide whether they want to attend in person or only participate in the owners' meeting via a screen.
