Property owners in Neuwied now have to dig much deeper into their pockets. This is because the Koblenz Administrative Court ruled that the city may raise the assessment rate for property tax B from 420% to 610% (5 K 1000/21.KO & 5 K 999/21.KO). Owners of residential properties had filed a complaint against this. However, without success.
The judges from Koblenz ruled that the property tax change notices were lawful and did not violate the rights of the plaintiffs. The increase in the assessment rate did not violate the so-called principle of equality, nor was it contrary to good faith or arbitrary.
Instead, the increase in the collection rate was even justified, as the city of Neuwied had a deficit of over eight million euros in the 2021 financial year. In these cases, the owners now have to pay several hundred euros more than originally planned. However, they are not prepared to accept this: they are now appealing to the Rhineland-Palatinate Higher Administrative Court.
