Verdict: Unauthorized advertising can cost moving companies a quarter of a million

Removal companies that drop unauthorized advertising material in letterboxes or in front of houses could be in for a price. The Munich Local Court has now threatened a removal company with a fine of up to EUR 250,000 or, alternatively, imprisonment for up to six months (case no.: 142 C 12408/21).

In this case, all letterboxes in an apartment building were marked "Please do not post any advertising". Nevertheless, the plaintiff found two flyers. Although these had not been posted, they had been stuck in the letterboxes in some other way. The removal company's argument that third parties could also have posted the advertising did not hold water with the competent judge.

The removal company also pointed out that it had instructed the contracted distributors to only distribute advertising in a permitted manner. The judge was not convinced by this either, as the defendant had to take appropriate measures - such as a contractual penalty agreement - to ensure that the distributors actually adhered to this.
