The taxpayers' association and the property owners' association Haus und Grund want to take legal action against property tax in five federal states. This is according to various media reports. One of the reasons for this is a study commissioned by the two associations. The study makes it clear that constitutional law expert Gregor Kirchhoff considers the federal law applied in numerous federal states to be unconstitutional.
The German Taxpayers' Association is also critical of the new property tax and criticizes that it will lead to considerable additional burdens. Owners who have already received a property tax assessment will in many cases have to pay higher property tax than before from 2025. The associations are therefore also advising owners to appeal against property tax assessments they have already received.
Property tax is one of the most important sources of revenue for local authorities. Property tax B is levied on other developed and undeveloped properties. The assessment rate for property tax is set by the local authorities themselves. The range between municipalities can therefore be extremely wide.
