Since January 1, 2022, new buildings must be equipped with higher chimneys. According to the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety, "newly built pellet heating systems, tiled stoves or fireplaces [...] must now have a chimney with an outlet opening that projects far enough above the roof to allow exhaust gases to be carried away by the natural air flow".
One of the aims of the amendment to the Federal Immission Control Act (BImSchV) is to better protect residents in residential areas from the harmful particulate matter that is produced during heating and escapes through chimneys. In future, chimneys must therefore protrude at least 40 centimetres above the roof ridge.
The Federal Council had already approved the amendment in mid-September 2021. The "First Ordinance Amending the Ordinance on Small and Medium-Sized Combustion Plants" was then published in the Federal Law Gazette on October 13, 2021, in which further requirements can also be found. According to the Federal Ministry for the Environment, only new combustion plants for solid fuels with a rated thermal input of less than one megawatt are affected by the amendment.
