In the area of burglary protection, the law also requires apartment owners and members of a condominium owners' association (WEG) to coordinate all planned measures with the community. This applies to the installation of window grilles, the installation of an alarm system or the installation of burglar-proof doors: Burglary protection is a community matter. The consumer protection association Wohnen im Eigentum (WiE) explains which measures are defined as structural changes and which are considered modernization measures.
Sometimes only a double qualified majority and the consent of at least 75 percent of the owners is required for the implementation of a measure to protect against burglary, as is the case, for example, with the installation of an alarm system or an electric door or intercom system. However, in the case of structural measures that change the facade of the property, all owners must give their consent. This is the case, for example, when window grilles are installed.
The situation is different if a burglary has already taken place and there is therefore an acute risk of burglary. In this case, the condominium owner may also carry out measures at his own expense without the consent of the WEG members, because in this case the WEG members are obliged to tolerate the measures. However, both the visual and the technical implementation must be coordinated with the other members. The pending reform of the Condominium Act is intended to simplify the implementation of structural measures for burglary protection in the future. Measures to protect against burglary are to be permitted with a simple majority.
