Resolutions in a condominium owners' association (WEG)

Anyone who owns a condominium is also part of a condominium owners' association (WEG). It is therefore important that future condominium owners inform themselves about their rights and obligations and find out what is hidden behind the terms declaration of division, special and common property or community rules, for example.

Likewise, future condominium owners should know the principle according to which joint resolutions are passed, which majority decides on the implementation of maintenance or repair measures and construction projects, or what options there are for objecting to joint resolutions. Whereas, for example, repairs to individual property do not require the consent of the other WEG members, construction measures on common property and decisions on the maintenance and management of the property must be voted on jointly.

Votes concerning the common property take place at least once a year in an owners' meeting. This often takes place at the end or beginning of the calendar year so that owners can also promptly discuss the house money available for the calendar year. While a simple majority is sufficient for decisions on the house rules, for example, modernization measures, such as the installation or replacement of an elevator, already require a three-quarters majority. If structural measures are planned that fundamentally and permanently change the nature of the residential complex, such as the addition of balconies, all owners must approve them.
