Draft law: Modernization of residential property management

On March 23, 2020, the German government enacted a bill to modernize residential property management (WEG management) and to promote electromobility. The Association of Property Managers Germany (VDIV) believes that the legislative process will be completed this summer. The new regulations and the WEG reform are intended to future-proof the system. Likewise, consumer protection is at the heart of the reform.

For example, the draft law provides for innovations in the area of construction measures. Until now, the consent of all or a majority of the owners has had to be obtained for all building projects. The new legislation is intended to allow owners to carry out barrier-free extensions and conversions, measures in the area of burglary protection, and the installation of a charging facility for electric vehicles and a fiber-optic connection without the consent of the other owners. The costs of the construction measures must be borne by the interested parties themselves if they take the initiative.

In order to simplify and accelerate decision-making in the WEG meeting, the option of virtual participation in a WEG meeting is to be provided in the future. It should also be possible to implement resolutions electronically. The quorum for circular resolutions is also to be minimized to 75 percent. The general aim of the reform is to make processes more flexible and implement measures more quickly. In addition, the draft law also includes other topics, such as the introduction of a certificate of expertise for the proper management of common property or the right to inspect management documents.
