WEG: Installation of e-charging stations on common property

Owners of an apartment in a residential complex who want to install a connection for an e-charging station for their electric car need the approval of the condominium owners' association (WEG). This is because the legal situation for the installation of a connection for e-power contains two major weaknesses. Firstly, the Home Ownership Act does not yet contain any regulations on the majority required at a condominium owners' meeting to approve the installation of an e-charging station. Secondly, interested condominium owners do not yet have a legal claim to the toleration of the construction measures. However, this could be decided in the future, because there is a draft law for the modernization of the Condominium Act.

As a rule, parking spaces in jointly used residential complexes are part of the common property, regardless of whether it is a parking space outside or in the underground garage. Thus, construction projects and modernization measures on the common property must be discussed with the owners' association and jointly decided. The association "Wohnen im Eigentum. Die Wohneigentümer e. V." (WiE) shows two possible approaches how interested apartment owners can apply for the installation of an e-charging station. One possibility is to apply for a resolution with the aim that the installation of the E-charging station is tolerated by the other owners of the WEG. Another possibility is to apply for the WEG to have an e-charging station installed on some or all of the parking spaces.

Accordingly, in the first variant, the interested owners would pay for the costs themselves. There are numerous conditions for this. For example, the construction work must be carried out by a specialist company and fire safety regulations must be complied with. If power lines have to be laid, it must be guaranteed that the electricity for the car is not billed via the community power supply. It is advantageous if the technical requirements for a charging station are already in place. An application for a resolution that affects the entire WEG makes sense if major technical prerequisites must first be created in the residential complex for the installation of the e-charging station. This is usually accompanied by major structural changes to the common property. With this resolution, the costs for the construction measures would be borne jointly and apportioned to all co-owners.
