New buildings have to be equipped with higher chimneys since January 1, 2022. According to the German Federal Ministry for the Environment, Nature Conservation and Nuclear Safety, "newly constructed pellet heating systems, tiled stoves or fireplaces [...] must now have a chimney whose outlet protrudes so far above the roof that exhaust gases can be carried away by the natural air flow."
One of the aims of the amendment to the Federal Immission Control Act (BImSchV) is to provide better protection for residents in residential areas against the health-endangering particulate matter that is produced during heating and escapes through chimneys. In future, chimneys must therefore project at least 40 centimeters above the roof ridge.
The Federal Council had already approved the amendment in mid-September 2021. The "First Ordinance Amending the Ordinance on Small and Medium-Sized Combustion Plants" was then published in the Federal Law Gazette on October 13, 2021, where further requirements can also be found. According to the Federal Environment Ministry, only new combustion plants for solid fuels with a rated thermal input of less than one megawatt are affected by the amendment.
