Verdict: Unauthorized advertising can cost moving companies a quarter of a million euros

If moving companies throw unauthorized advertising material into mailboxes or place it in front of houses, it could be expensive for them. The Munich Local Court (Amtsgericht München) has threatened to impose an administrative fine of up to EUR 250,000 or up to six months' imprisonment on a removal company in the event of a repetition of this practice (Ref.: 142 C 12408/21).

In the case at hand, all mailboxes of an apartment building were marked "Please do not post any advertising". Nevertheless, the plaintiff found two flyers. Although these had not been posted, they had been stuck in the mailbox in some other way. The relocation company's argument that third parties could also have posted the advertisements was not accepted by the competent judge.

The removal company also pointed out that it had instructed the contracted delivery staff to distribute advertising only in a permitted manner. The judge was not convinced by this either, because the defendant would have to take appropriate measures - such as an agreement on contractual penalties - to ensure that the delivery staff actually complied with this.
