The Federal Association of Consumer Organizations warns against misleading advertising letters from Nowenergy, Primastrom and Voxenergie. These letters suggest a price reduction, but lead to new contracts with significantly higher prices when signed. Customers who sign a new contract in this way would also lose the opportunity to take action against invalid price increases in the past.
The providers concerned had not agreed any or no effective price adjustment clauses in the contracts in the past. Therefore, the price increases in the current contract are not possible. This means that only the price at which the contract was concluded can be demanded. However, according to the consumer advice center, the new contracts offered in advertising letters contain clauses that allow future price increases. Customers who accept these offers would be bound to high prices and long terms, often over 24 months.
The Federal Association of Consumer Organizations therefore advises caution with such advertising letters and recommends critically examining existing contracts and taking action against unjustified price increases. It had filed a class action against Primastrom and Voxenergie in order to take action against "repeated massive price increases". An out-of-court settlement was reached with Primastrom and Voxenergie. Customers who had joined them will receive any credit balances back.
