Since October 17, 2024, the holding of virtual homeowners' meetings (WEG) has been permitted by law (Section 23 (1a) WEG). This enables condominium owners to decide on resolutions without being physically present.
With a required three-quarters majority of the votes cast, condominium owners can decide that the WEG can be held as a virtual owners' meeting for three years from the date of the resolution. If condominium owners pass a resolution to this effect, they must still hold at least one face-to-face meeting per year up to and including 2028. Exception: they decide unanimously to dispense with this.
The introduction of this regulation requires administrators to adapt to the new technical and organizational challenges in order to ensure the equivalence of participation and exercise of rights in virtual and physical meetings. The new legal regulation not only promotes flexibility, but also takes into account the needs of a digitalized society.
