Anyone who builds a house must ensure that certain distance areas to the neighboring property are observed. But there are not only rules for the location of the house. The distance regulations also apply to the garage, a garden shed or the roofing of the terrace. In Germany, a minimum distance of 2.5 to 3 meters to the neighboring property applies. Compliance with the prescribed minimum distance is intended to guarantee residents sufficient incidence of light as well as sufficient sight distance. The minimum distance also ensures compliance with fire protection regulations.
If the distance areas are not complied with, this is referred to as boundary construction. Only in certain cases is it permitted to go below the minimum distance. On the one hand, this requires the consent of the neighbors and, on the other hand, compliance with the regulations from the neighborhood law. The regulations from the state building codes and the specifications from the development plans must also be observed. Some specifications in the building codes differ from state to state. However, most of the regulations are very similar.
The building height is decisive for the exact calculation of the distance area. This is made up of the height of the building up to the roof and the height of the roof. Depending on the roof pitch, the height of the roof is only partially calculated. The factors F and FD stipulated in the building regulations play an essential role in the calculation of the distance area. The distance areas always refer to the entire width of the facade. Further details, such as the window right, regulations on the neighboring wall and the boundary wall or details on the property enclosure, are stipulated in the neighborhood law.
