Cable television: Abolition of the ancillary cost privilege

If landlords have concluded collective contracts with cable providers, they should check a possible termination. The portal mietercheck.de points this out. The reason for this is the abolition of the so-called ancillary cost privilege for cable charges. A corresponding law in addition stepped already on 1 December 2021 into force, however still a transition period applies up to 30 June 2024.

In this context, the consumer advice center points out that special regulations apply in owners' associations. Although there is a special right of termination for collective contracts as of June 31, 2024, it could also happen that an owners' association decides against termination. If this is the case, the condominium owners must continue to pay the fees, but they may no longer pass them on to their tenants.

Due to the ancillary cost privilege for cable fees, tenants used to have to pay for cable fees in the case of collective contracts with their landlord, even if they did not use this type of reception at all. Since the amendment, they are free to choose the type of reception "without paying twice for their TV reception," as the consumer advice center writes, and can switch to alternatives or sign a contract with a cable provider themselves.
